Sexual Offences Act 2003

The Sexual Offences Act 2003 is the act of parliament of the United Kingdom. It replaced the older sexual offences law with a more specific and explicit wording. It also creates several new offences such as non-consensual, causing a child to forcibly watch a sexual act and assault by penetration.

Major Changes in the Act

Part 1 of the Act makes many new changes to the sexual crimes law in England and Wales, which almost replaces the Sexual Offences Act 1956.

Rape has been redefined in the Sexual Offences Act 1956 (amended in 1976 and 1994).

    Transition from old to new law

    The 2003 Act takes most sections of the Sexual Offences Act 1956 and several others statutes dealing with sexual offences. Section 141 of Act gave Home Secretary the power to make rules by statutory instrument to deal with the change from the old to the new laws, to cover the situation where a defendant is being charged with the offences which overlap the commencement date of May 1, 2004.
